A prenuptial agreement is a contract which the parties enter into before marriage. A prenuptial agreement determines what each party’s rights will be at the time the marriage is later terminated by divorce and/or often when one of the parties dies.  Prenuptial agreements can control issues of alimony and spousal support, the division of assets, or how your or your spouse’s estate will be distributed. Prenuptial Agreements set the rights of parties when the circumstances related to a divorce or deceased’s spouse’s estate are unknown. The economics of the relationship may be very different than they were at the time of the marriage.  There are statutory requirements that must be met in order to make a prenuptial agreement valid and enforceable.  If you are contemplating a prenuptial agreement, or your future spouse wants to have one prepared, it is critical that you consult and get advice about it from an experienced family law attorney.
